“NeHC is offering a Special National Health IT Week Stakeholder Forum on Multi-Party Legal Agreements for Health Information Exchange as an opportunity for all stakeholders, especially state decision makers, to understand how multi-party legal agreements can be effective for data-sharing at the state level.

“This session is intended to provide decision makers and others with a foundational legal concept for understanding potential applications of multi-party data-sharing agreements. The Data Use and Reciprocal Services Agreement (DURSA) used by the NHIN Exchange will be presented as a case study in the development of multi-party agreements and participants will learn about those aspects of the DURSA that may be applicable to state level agreements.

“Experts from the ONC Office of Policy and Planning and the ONC Office of State and Community Programs, as well as the State-Level HIE Project led by the AHIMA Foundation (technical assistance provider to state HIE grantees), will be on hand to answer questions from stakeholders and participate in the discussion.

“LEARNING OBJECTIVES: By participating in this Stakeholder Forum, participants will:

    Learn about the pros and cons of multi-party legal data-sharing agreements for health information exchange

  • Learn about aspects of the DURSA that may impact HIE development for states
  • Take away information that will inform state-level plans to consider participation in interstate HIE or the NHIN Exchange”

2010 Annual Survey Results Posted
eHealth Initiative survey deadlines June 24, 2010 and  is “designed to capture health information exchange activities across the country and the results will be used to identify trends, inform policy, and support the forward movement of HIE.” Results will be released at eHealth Initiative’s National Forum on Health Information Exchange on July 22, 2010 in Washington, DC.

Per eHi Web site: “Any groups engaged in health information exchange are invited to participate.”

“You should complete this survey,
– if your organization is planning for health information exchange at the national, regional, state, or community level; OR
– building or maintaining a technical infrastructure to support health information exchange; OR
– federally funded as a state designated entity; OR
– facilitating the exchange of data between at least two different stakeholders, such as a hospital and physician practice; OR —not directly involved in building a technical infrastructure, but coordinating or creating policy to facilitate health information exchange.”

HIE Plans from Alabama, Arkansas, California, Connecticut, Florida, Illinois, Indiana, Iowa, Kansas, Louisiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Missouri, Nebraska, New Hampshire, New Jersey, New Mexico, New York, North Carolina, Oregon, Pennsylvania, Rhode Island, South Carolina, Tennessee, Texas, Utah, Virginia, Washington, Wisconsin
Updated November 21, 2010. New York submitted its operational plan to ONC on October 26, 2010. Indiana and Kansas State HIE Strategic and Operational Plans were submitted to ONC on August 31, 2010.  Listed below are thirty-two State HIE Strategic and Operational Plans developed for submission to Office of the National Coordinator (ONC) for Health IT. List includes New Mexico, Maryland, Maine, and Utah Strategic and Operational Plans that have already been approved by ONC. Reportedly two additional unnamed state plans have been approved by ONC but not yet officially announced. Some versions of the plans below are drafts, have not yet have been submitted to ONC, and may be under state review prior to submission. Some of the dates by each listing below and on the linked documents may refer to a date of expected submission to ONC and not to the date of the actual version. On June 10, 2010 the Office of the National Coordinator (ONC) for Health IT posted the approved Strategic and Operational Plan for the Maryland Health Information Exchange (HIE) on the  State HIE Toolkit.  Maryland’s plan was added to ONC-approved plans already posted for Utah and New Mexico.

NORC (National Opinion Research Center) at the University of Chicago made a presentation to State HIE Leaders on May 20, 2010 on the evaluation project that Office of National Coordinator (ONC) for Health IT has hired them to perform. NORC will seek best practices and evaluate progress of state programs against those best practices and goals of the State HIE Cooperative Agreement Program.

Overview of the Evaluation
• ONC awarded NORC contract in March 2010 to:
          Evaluation of the State Health Information Exchange (HIE)

         Assess the effectiveness of the Program in furthering information exchange capability within states

1. What are the various approaches that states are taking to enable or facilitate health information exchange?

Case Studies
• Objective: Identify lessons learned and strategies for overcoming barriers to HIE
• After reviewing the state plans, the evaluation team will propose a selection of possible candidates for the TAG’s review and approval.

          Stage of development
          Best practices for rapid implementation
         Overall model, scope and level of stakeholder participation
         Innovative or different technical approach
         Services provided
         Geographic diversity/Approaches to interstate exchange
• A case study report of key findings will be produced and shared with the program managers

Case Studies Approach
• Case studies to involve:
         Site visits
         Analysis of background materials and developing profiles of selected states
         One-on-one discussions with HIE leadership and stakeholders
         Focus group discussions with users and non-users

Evaluation Technical Assistance
• The evaluation team will provide technical assistance to the
states in their evaluation efforts by:
          Conducting webinars and teleconferences related to specific components of evaluation
          Holding evaluation seminars/workshops for state evaluation personnel to share ideas and listen to best practices
         Collating available tools and resources on evaluation
• What other approaches to technical assistance would be helpful?

Background on Performance Measures
• Reporting on performance measures is a program requirement and stipulated as part of the funding received by all states
• Purpose is to provide assessments on the overall progress and success of the Cooperative Agreement Program
• Focus is to develop measures that allow ONC to gain a deeper understanding of the current level of exchange within each state program and monitor changes over time
• Evaluation team to collaborate with ONC to develop baseline performance measures that relate to the development of HIE and compliments the overall evaluation

Selection and Design
Factors considered:
• Relevance of the measure across or within each of the phases of HIE maturity
• Relevance of the measures to the proposed meaningful use criteria
• Availability of data sources which could populate each measure
• Feasibility of states to get access to data sources

Approach
• Assist ONC in the development of a draft set of process-based and outcome-based measures
• Refine the draft set of measures with input from states and ONC

CMS Awards Add’l $9.1 Mil for Medicaid Health IT to New Jersey, Louisiana, Maryland, and Minnesota

Four New CMS Awards for Health IT Programs for Medicaid
Ups  Total to $67.6 Mil for 41 State/Territory Medicaid Agencies
Centers for Medicare and Medicaid (CMS) announced its four latest federal matching fund awards on May 11, 2010 as part of the CMS Electronic Health Records Incentive Program with $9.2 million in this round divided between the Medicaid agencies for New Jersey with $4.93 million, Louisiana with $1.85 million, Maryland with $1.37 million, and Minnesota with $1.04 million.

Among the 41 State/Territory Medicaid agencies, New Jersey captured the second largest award, with New York maintaining its top spot at $5.91 million. The midpoint for award amounts remains about $1.4 million per agency. See complete chart below with states, amounts, and dates announced.

The press release for each state award continues to say “The Recovery Act provides a 90 percent federal match for state planning activities to administer the incentive payments to Medicaid providers, to ensure their proper payments through audits and to participate in statewide efforts to promote interoperability and meaningful use of EHR technology statewide and, eventually, across the nation.”

 of scheduling shifts, the Boston-based national conference on Health IT with 600 participants from 30 states on April 29-30, 2010, included inspirational keynotes from National Coordinator for Health IT David Blumenthal and Surgeon General Regina Benjamin, as well as an enthusiastic welcome from host Governor Deval Patrick who moderated a panel as well.

Off stage state HIE and Medicaid directors and leaders took the opportunity to network and compare notes, as well as take advantage of the smaller workshops where session leaders focused on encouraging discussion and bringing up issues that needed to be addressed in the accelerating Health IT federal-state initiative.

Bernie Monegain reported for Healthcare IT on April 30, 2010, “The government will announce ‘soon – it should be very, very soon’ which 15 communities of the 130 that applied will be awarded Beacon Community grants, National Coordinator for Health IT David Blumenthal, MD, said.” In addition to supporting improved electronic health record implementation and information exchange in communities that have already demonstrated great strengths in those capabilities, these Beacon communities will share lessons learned and best practices in achieving measurable outcomes in  health care quality, safety, efficiency, and population health with communities across the country, according to the Office of the National Coordinator site. 

CMIO.net story by  Jeff Byers  on April 29, 2010 was headlined “CMIO Blumenthal gets personal, calls for teamwork among health IT pros.” Seeing younger colleagues using electronic health records, Blumenthal noted, per Byers reporting, “I was not going to be the only one in my physician group of ten not using it.”  Blumenthal’s message is increasingly appealing to physicians’ sense of professionalism and focus on delivering the best patient care.

Byers futher reported April 29, 2010 in CMIO.net on a discussion of the role of consumers and patients in Health IT by a  ”Panel: How do HIEs, EMRs affect patient-physician experience?,” and provides the viewpoint of each of the panelists. 

ComputerWorld’s article by Lucas Mearian on April 30, 2010 reported “Health IT funding to create 50,000 jobs; Sixty regional IT help centers will help health care facilities implement electronic medical records.”

In addition to regional collaboration meetings among state officials grouped according to CMS regions, Workshops included “Achieving Sustainable Success,” Making a Difference–Health IT and Clinical Quality Improvement,” “State Initiatives in Healthcare Reform,” “Successful HIEs–How They Did It and How Ii Helps,” “Jobs, Jobs, Jobs–Health IT and State Economic Development Policy,” Creating Effective Public/Private Partnerships,” “EHR Early Adopters–How They Did It and How It Helps,” and “Health IT, HIE, and Public Health.”

One key panel, providing a sweeping overview of Health IT policies and standards, was moderated by Internet publisher pioneer Tim O’Reilly of O”Reilly Communications.

State HIE Directors are reportedly meeting with the ONC next week, and this conference acted as a bit of a warmup, with relatively new officials getting to connect, and others catch up.
